Privacy policy
How Island Warranties, Latent Defects and Finance Delta Ltd use your personal information. This policy follows our privacy notice LDI-PN 2.3 (9 October 2026) - the notice we give with every proposal - and adds the parts that apply to this website.
1. Who we are
Island Warranties is a trading style of Latent Defects, a trading name of Finance Delta Ltd. Finance Delta Ltd is the controller of the personal information described in this policy. We are registered in England and Wales, company number 08244313, and our address is 105-107 Farringdon Road, London EC1R 3BU. We are authorised and regulated by the Financial Conduct Authority, firm reference number 912378. We are an insurance intermediary - we arrange cover, we do not provide it. We are registered with the Information Commissioner's Office, registration number ZA599204.
If you have any questions about this policy or your information, call us on +44 (0)3300 43 42 45, email us or write to us at the address above.
2. Whose information this covers
People who visit this website or send us an enquiry, and professionals who refer a client to us. Our clients are usually companies - property developers and builders - so if you go ahead, we also hold information about people connected with the development, including:
- directors, owners, partners and staff of the developer, and the person who signs the proposal and accepts the quote
- contacts at the main contractor, the parent company, the architect, engineer and other professionals
- the person who gives access to the site for inspections
- later on, buyers and owners of the homes or units where their details are needed for the certificates or a claim
If you give us information about someone else, please make sure they know you are doing so and point them to this policy.
3. The information we collect
When you use this website or send us an enquiry:
- Contact details - your name, firm, email address and phone number.
- Project details - where the site is, the type and size of the development, the stage of the build and anything else you tell us about it.
- Referral details - if a professional refers you, the details they give us about you and your project, and their own contact details.
- Technical information - your IP address and browser when you send a form, that you ticked to agree to us contacting you, and which page or campaign brought you to the site.
If you go ahead with a proposal:
- Identity and contact details - names, job titles, company names, addresses, email addresses and telephone numbers.
- Information about the development and its people - the site, the build, the professional team, experience, previous developments and any history with other warranty providers.
- Answers to the declaration questions on the proposal form, which may include whether a person connected with the applicant has been prosecuted, refused insurance, had losses or been involved in an insolvency.
- Results of the checks we carry out - Companies House records, sanctions screening and credit checks.
- Records of your approval and acceptance - your name, position, drawn signature, the date and time and the internet address it came from - and the documents we issue to you.
- Correspondence - our emails, messages and call notes with you, and the documents you send us such as plans and schedules.
4. Where it comes from
- You, or someone acting for you such as your agent, architect, contractor or the professional who referred you.
- This website, and Google Analytics, for the technical information above.
- Public records - Companies House and the UK sanctions list kept by the Foreign, Commonwealth and Development Office.
- Credit reference agencies, when we carry out a credit check.
- The managing general agent, insurers, surveyors and technical inspectors involved in your cover.
5. How we use it and why we are allowed to
- To answer your enquiry, prepare the proposal, obtain quotes, arrange the cover and help with it afterwards. Where our client is a company or partnership, we use the details of its directors, staff and other contacts because it is in our legitimate interests, and the business's, to arrange the cover it has asked for. Where our client is an individual, such as a sole trader, we use their information because it is needed to take steps at their request before a contract and to perform our contract with them.
- To check who we are dealing with, screen against sanctions and prevent fraud and other financial crime - to comply with the law, including sanctions law, and in our legitimate interests in meeting the standards our regulator expects of us and protecting our business and the insurers we work with.
- To keep records of the non-advised service we gave, the documents we issued and the acceptance of our terms, to handle complaints and to meet the rules of the Financial Conduct Authority - to meet our legal and regulatory obligations.
- To keep in touch about the cover, renewals or similar products - in our legitimate interests. We only send marketing where the law allows, and you can ask us to stop at any time.
- To run, measure and protect this website - counting visits and seeing which pages lead to enquiries so we can improve the site, and stopping spam and misuse - in our legitimate interests. You can turn the website statistics off on our cookie policy page.
Information about criminal offences that comes from the declaration questions is used only to arrange and administer insurance, as the insurance condition in Schedule 1 of the Data Protection Act 2018 allows.
We need the information asked for on the proposal form to obtain quotes and arrange cover. If it is not given, or is not complete and accurate, insurers may not be able to quote, or the cover could be affected.
6. Who we share it with
- The managing general agent (MGA) we place your proposal with and the insurers it acts for - they are named on your quotation. They use your information to provide quotes and cover and have their own privacy notices, which they will give you or we can send you.
- Surveyors and technical inspection providers who inspect the build.
- Credit reference and fraud prevention agencies, when we carry out checks.
- The professional who referred you, where you have agreed to us keeping them informed.
- Google, which provides our website statistics.
- Our regulators and the Financial Ombudsman Service, our professional advisers and auditors, and law enforcement where the law requires it.
- Our service providers - see section 7.
We do not sell personal information.
7. Our service providers and technology
We use carefully chosen service providers to run our systems - website hosting, email, messaging, document storage and secure online signing. We also use an artificial intelligence service to help read and organise the emails and documents you send us so we can fill in the proposal accurately. A member of our team checks everything before it is used. Our providers act on our instructions under written terms, must keep the information secure, and may not use it for their own purposes, including training artificial intelligence models.
If you use Warranty with WhatsApp, your messages travel through WhatsApp, which is part of Meta and handles them under its own terms and privacy policy. We keep the messages about your enquiry with your enquiry record. In UK working hours a member of our team replies. Out of hours, or for quick basic requests, our artificial intelligence assistant may reply, and anything it cannot help with is passed to the team.
WARRANTYWIZARD, the chat on this website, is an artificial intelligence assistant. When you ask it a question, your question and the recent conversation are sent to our artificial intelligence provider, Anthropic, to produce the answer straight away - nobody checks the answer before you see it, and like any AI it can occasionally make mistakes. WARRANTYWIZARD gives general information only - it does not give advice, make decisions about you or decide whether you can get cover. We keep the questions and answers, with your internet address and browser type, so we can check the answers, improve them and stop misuse. Please do not type personal or financial details into it. To check that questions come from a person and not a robot, WARRANTYWIZARD uses Google reCAPTCHA, which looks at information about your device and how you use the page, under the Google Privacy Policy and Terms of Service.
8. Transfers outside the UK
Some of our service providers process information outside the UK. Where they do, we make sure it is protected - by using countries the UK recognises as giving adequate protection, or by using the UK International Data Transfer Agreement or Addendum or another safeguard the law allows. You can ask us for details of the safeguards we use.
9. Automated decisions
We do not make decisions about you that have legal or similarly significant effects using automated means alone. The insurer decides whether to offer cover and on what terms - its privacy notice explains how it does so.
10. How long we keep it
We keep information only for as long as we need it, for these reasons:
- Structural warranty cover runs for 10 or 12 years from practical completion, and claims and questions can arise throughout that time. We keep the proposal, the quotation, the documents we issued and the record of acceptance for the life of the cover and for 6 years after it ends, so we can help with claims and deal with any complaint or legal claim.
- Results of identity, sanctions and credit checks are kept for 5 years after our relationship ends, under our financial crime procedures, then deleted.
- If an enquiry or proposal does not go ahead, we keep the information for up to 3 years in case you come back to us or there is a query, then delete it.
- WARRANTYWIZARD questions and answers are kept for up to 12 months, then deleted.
- Website statistics in Google Analytics are kept for no longer than 14 months.
11. Your rights
You have the right to ask for a copy of the information we hold about you, to have it corrected, to have it deleted or its use restricted, and to have information you gave us passed to you or someone else in a usable form. Some of these rights do not apply in every case - for example we must keep insurance records the law requires.
Your right to object. Where we use your information because it is in our legitimate interests, you can object at any time and we will stop unless we have compelling grounds to continue or need it for a legal claim. You can always object to marketing and we will stop.
To use any of these rights, contact us using the details in section 1. We will reply within one month.
12. Keeping it secure
This website only works over a secure connection. Your private links to approve your proposal and see your quotes use a long random code that cannot be guessed. Access to our systems is limited to staff who need it.
13. Complaints
If you are unhappy with how we have used your information, please contact us first and we will try to put it right. You can also complain to the Information Commissioner's Office at ico.org.uk/make-a-complaint or on 0303 123 1113.
14. Cookies
See our cookie policy for the few cookies this website uses and how to turn the website statistics off.
15. Changes to this policy
We may update this policy from time to time. The current version is always on this page. Last updated October 2026.
